A quick insurance question for mother in law

If someone drives into a turning circle then reverses into a parked car which someone is getting out of, is it the person reversing at fault.
I say yes, undue care and attention. He would have seen her car there as he drove in if he was looking.

However minlaws ins says her fault as he was reversing.

i'd have said it was the person reversing, purely because the other car was parked up stationary, how can it be that cars fault?

Wait... surely it's obviously his fault if he's the one maneuvering a car?! If your MIL was out of sight of the car, a matter of seconds later, for example, would it be her 'fault' still?

Yep.

Not sure if she had the door open or not. Even so her car was parked. He should have been looking. If it was me and i hit an open door on a parked car id take the hit.

I think her ins (saga) wants an easy hit

Sounds a bit suspect. What's the insurer's reasoning for blaming the MIL?

Its the person doing the reversing since she is parked engine is off car handbrake on ect ect so her car cannot magically move into the other car, it is that other persons responcibility to ensure that he has enough space to be able to compleate the turn... great job for looking at obsticals

As i understand it she was in the car when he pulled in to the turning area, then she opened her car door, then he reversed into it, not much damage but i think her insurance thinks she opened the door while he was reversing and are now blaming her or are looking at knock for knock.

Don't know if this changes things, hence the request for advice.

Not sure if it was already open when he started reversing or she opened it while he was reversing, i haven't managed to speak to her since.

I also wasn't aware of the door being open(ed) when i spoke to her originally.

i'm assuming if she was opening the door and he was ALREADY reversing it's her fault, if the door was already open when he started reversing it is his fault.

Although if i knew that in the first place i may not have asked this question.

On a seperate note but still related to MIL, if she has been named driver on someone elses insurance but never had insurance am i right in assuming she has no no-claims, or is that dependant on the insurance company?

Sorry for the multiple questions, meant to ask about that originally.

It's likely that she doesn't have any of her own bonus to use. If she insures with the same insurer they may give her an introductory discount but many don't for the named driver scenario as there's no proof of how much she actually drove the car.
